Al-Fārābī's lost commentary on Aristotle's Ethica Nicomachea is without doubt one of the most sorely missed lost works of the Islamic falāsifa. In part, this is because the commentary was in some respects a scandal, and scholars accordingly believe it may hold the key to resolving present-day disagreements on how to interpret al-Fārābī's views as expressed in his independent treatises. Perhaps al-Fārābī's most shocking or scandalous statement is that preserved by the Hispano-Muslim philosophers Ibn Bājja, Ibn Ṭufayl, and Ibn Rushd. (...) According to them al-Fārābī says in his commentary on Aristotle's Ethica Nicomachea that happiness is to be achieved only in this life, not in the afterlife; that there is no happiness but political happiness; and that union with the active intellect – generally considered the highest goal of human existence by the philosophers – is impossible. This paper addresses the following questions: What exactly is the debate about? Why is the question of immortality or conjunction related to Aristotle's Ethica Nicomachea? And why was it so controversial to say, in the context of the Ethica Nicomachea, that there is no happiness but political happiness? Although the bulk of al-Fārābī's commentary is still lost, I have discovered two quotations of it in Hebrew manuscripts. As I will argue in this paper, these newly-discovered quotations – which are included with an English translation in the appendix – can shed light on the mysteries concerning al-Fārābī's commentary. Résumé Le commentaire perdu d'al-Fārābī à l’ Ethique à Nicomaque d'Aristote est sans conteste, parmi les ouvrages perdus de philosophes islamiques, l'un de ceux dont on regrette le plus l'absence. Cela s'explique notamment par le caractère à certains égards scandaleux de ce commentaire, dont les spécialistes attendent dès lors qu'il recèle la clé pour résoudre les désaccords actuels quant à l'interprétation à donner aux idées formulées par cet auteur dans ses traités personnels. La thèse peut-être la plus choquante ou scandaleuse d'al-Fārābī est celle qui est préservée par les philosophes hispano-islamiques Ibn Bājja, Ibn Ṭufayl et Ibn Rushd: selon eux, il affirme, dans son commentaire à l’ Ethique à Nicomaque, que le bonheur ne saurait se réaliser qu'en cette vie et non dans l'au-delà, qu'il n'y a pas de bonheur autre que le bonheur politique, et que l'union à l'intellect agent – généralement tenue par les philosophes pour être la fin suprême de l'existence humaine – est impossible. Cet article traite les questions suivantes: quel est exactement l'enjeu de ce débat? Pourquoi les questions de l'immortalité et de la conjonction sont-elles liées à l’ Ethique à Nicomaque? Et en quoi était-il si problématique d'affirmer, en référence à cette œuvre, qu'il n'y a pas de bonheur autre que le bonheur politique? Même si le corps du commentaire d'al-Fārābī est encore perdu, j'en ai découvert deux citations dans des manuscrits hébreux. Comme je le soutiens ici, ces citations récemment découvertes – données dans l'appendice avec leur traduction anglaise – font un peu de lumière sur les mystères du commentaire d'al-Fārābī. (shrink)

La rhetorique n'est pas la discipline qui s'occupe essentiellement des figures de rhetorique: celles-ci ne sont plus qu'un outil parmi d'autres pour persuader et convaincre un auditoire. Dans toute sa generalite, elle constitue une theorie de l'argumentation, qui se sert de raisonnements qu'Aristote qualifiait de dialectiques. En ce sens la rhetorique, qui englobe la dialectique des Anciens, est le pendant de la logique formelle, car c'est l'instrument indispensable de toute pensee qui ne se reduit pas a un calcul. Toute deliberation, (...) toute discussion, toute controverse, toute presentation d'idees nouvelles qui fait appel a la raison, est obligee d'y recourir. La rhetorique est ainsi l'instrument indispensable de toute pensee et de toute philosophie critique. L'etude des techniques d'argumentation, et de leurs presupposes, longtemps negligee par le rationalisme classique, d'inspiration mathematique, est presentee dans ses perspectives historiques et philosophiques. La interpretación jurídica consiste en descubrir la solución en los supuestos dados con arreglo al derecho vigente. La interpretación es siempre necesaria porque no existen casos claros y a quien incumbe la tarea de decidir la interpretación del derecho es a los jueces y funcionarios, al resolver los casos que se presentan a su consideración. Una característica destacable de la interpretación judicial es la búsqueda de una solución basada en la equidad. Otra de las tareas de la interpretación es la (...) solución de conflictos y, en este sentido, el recurso a los principios y a la lógica de lo razonable suministra la solución aceptable. Esta dialéctica entre el legislativo, los jueces, la doctrina y la opinión pública constituyen la vida del derecho, conciliando de este modo la estabilidad y el cambio. (shrink)

Resumen: El propósito de este trabajo es mostrar cómo la propuesta de la nueva retórica de Chaïm Perelman se constituye fundamentalmente en una teoría de la racionalidad práctica en perspectiva argumentativa. Para el desarrollo de esta tesis procedemos de la siguiente manera: primero se describe el giro pragmático que lleva a Perelman a señalar los límites de la lógica formal deductivista para el campo de los valores en algunos de sus textos de juventud; a continuación se muestra la apuesta de (...) Perelman por una nueva retórica como un tipo de aplicación de la racionalidad, desarrollada en su Tratado de la argumentación y algunos textos posteriores a 1958; y finalmente se desarrolla la noción perelmaniana de lo razonable en el marco de la argumentación jurídica, para mostrar cómo, desde esta perspectiva, Perelman se vincula al debate de la segunda mitad del siglo XX conocido como la “doctrina de los casos difíciles en derecho”.: The purpose of this work is to show how Chaïm Perelman’s new rhetoric proposal fundamentally constitutes a theory of practical rationality in an argumentative perspective. To develop this thesis, we proceed as follows: first, we describe the pragmatic turn that leads Perelman to point out the limits of formal deductivist logic in the field of values, in some of his youth texts; then, Perelman’s bet on new rhetoric is presented as a kind of application of rationality, developed in his Treaty of Argumentation and in some texts written after 1958; finally, the Perelmanian notion of reason is developed in the framework of legal argumentation, to show how, from this perspective, Perelman is linked to the debate of the second half of the twentieth century known as the “doctrine of difficult cases in law”. Este trabajo presenta en su primera parte un resumen de la teoría de la argumentación de Chaim Perelman y Lucie Olbrechts-Tyteca. En él se destacan los elementos esenciales de esa teoría: su punto de partida como crítica a la concepción clásica de la racionalidad en Occidente, pensada desde Descartes como idéntica a la razón demostrativa; el origen aristotélico de la argumentación en la retórica o arte de la persuasión; el concepto de "auditorio universal" como destinatario de los argumentos; la (...) noción de "razonable" y su relación con el concepto de lo "racional". En la segunda parte se somete a crítica la posición de los autores frente a la relación entre lo racional y lo razonable. Se defiende la tesis de que lo racional es condición necesaria de lo razonable (cosa que no aceptan Perelman y Olbrechts), y para hacerlo, se apela a las ideas de Piaget sobre la existencia de una "lógica natural"; se usa el concepto de cálculo de la deducción natural como una clase de formalismo lógico aplicado a la argumentación; se utilizan las ideas de Apostel y de Grice sobre la implicación conversacional, y se aplica el formalismo construido por von Wright para el análisis lógico de la acción, con el fin de clasificar los tipos elementales de acción argumentativa. En el texto se presenta a la sofística como precursora de la filosofía práctica, y se la reconoce como anticipadora del pensamiento aristotélico. La vía por la que se muestra dicha relación es el reconocimiento del papel primordial que esta concede al lenguaje y en especial al que adquiere la forma de discursos que buscan persuadir, a la retórica como piedra angular de la formación ciudadana en cuanto preparación para la vida pública. De esta manera se reconoce la importancia que (...) la retórica tuvo para la filosofía en sus orígenes, y cómo perfilaba otra manera de entender la racionalidad, no como teórica sino como práctica. Después se pasa a mostrar cómo según Chaïm Perelman, a partir de una reinterpretación de cierta parte de la obra de Aristóteles, es plausible postular a la retórica como un modelo más adecuado para entender la filosofía. All these activities of living beings, and the functioning of their organs, and the functioning of instruments demand a teleological explanation. Why do human beings toil? Why do living beings try to maintain the activities of the organism? What are the functions of specific organs or instruments? Intelligible answers can be given in teleological terms. Of course, one could ask many questions about these situations that would not require the teleological explanation; for example, questions concerning the mechanical structure of living (...) beings or of instruments. Yet this fact would not eliminate the legitimacy nor the utility of the teleological category. (shrink)

The ArgumentYehuda Halevi'sKuzariwas written in response to the challenge posed to Judaism by a highly spiritual, nondenominational philosophy. Science, especially that embodied in the Hellenistic heritage, was a major component of philosophy; thus, if for no other reason than to make Judaism a serious competitor, Halevi had to show that the Jewish tradition as well possessed a body of scientific knowledge. The superiority of the Jewish teachings was demonstrated chiefly by appeal to the criteria of tradition, consensus, and authority, which, (...) in Halevi's judgement, were in practice the criteria most influential in deciding scientific opinion. Despite the rather unique setting for the book, and the wide range of stances Halevi develops, theKuzariwas rather quickly and smoothly absorbed into the mainstream of Jewish religious thought. In this study, complex dynamics of Briggs–Rauscher reaction system is investigated analytically and numerically. First, the Briggs–Rauscher reaction system is reduced into a new nonlinear parametric oscillator. The Melnikov method is used to derive the condition of the appearance of horseshoe chaos in the cases ω = Ω and ω ≠ Ω. The performed numerical simulations confirm the obtained analytical predictions. Second, the prediction of coexisting attractors is investigated by solving numerically the new nonlinear parametric ordinary differential equation via the (...) fourth-order Runge–Kutta algorithm. As results, it is found that the new nonlinear chemical system displays various coexisting behaviors of symmetric and asymmetric attractors. In addition, the system presents a rich variety of bifurcations phenomena such as symmetry breaking, symmetry restoring, period doubling, reverse period doubling, period-m bubbles, reverse period-m bubbles, intermittency, and antimonotonicity. On the contrary, emerging chaotic band attractors and period-1, period-3, period-9, and period-m bubbles routes to chaos occur in this system. (shrink)

This article examines the impact of traditional Chinese culture on organ donation from the perspective of Confucianism, Buddhism, and Taoism. In each of these cultural systems, it appears that there are some particular sayings or remarks that are often taken in modern Chinese society to be contrary to organ donation, especially cadaveric organ donation. However, this article argues that the central concerns of Buddhism, Confucianism, and Taoism are “great love,” “ren,” and “dao,” which can be reasonably interpreted to support organ (...) donation. The author understands that each cultural system, in order to play its cultural function, must have its central concerns as well as relevant ritual practices (li) that incarnate its religious and ethical commitments. That is, each plays a general cultural role, which influences organ donation in particular not merely through abstract or general ethical principles and teachings, but through a combination of ethical teachings and the forming of particular ritual practices. This article contends that the primary reason Chinese individuals fail to donate sufficient cadaveric organs for transplantation is not because particular remarks or sayings from each of these systems appear to conflict with donation. Neither is it that the central concerns of these systems cannot support cadaveric donation. Rather, it is that modern Chinese individuals have failed to develop and secure relevant ritual practices that support the central concerns of organ transplantation. The article concludes that in order to promote more donations, there is a need to form relevant ritual practices supporting organ donation in conformity with the central concerns of these cultural systems.
